Liability waiver
Release of liability, assumption of risk and indemnity agreement
Columbia Gadget Works (“CGW”) is a nonprofit community makerspace at 1404 Grand Ave, Columbia, Missouri. In exchange for being allowed to enter the shop, use its tools, equipment and materials, and take part in its trainings, classes and events (together, “the activities”), I agree as follows.
The activities are dangerous. I understand that the shop contains power tools, hand tools, machines, lasers, heat, sharp edges, chemicals, fumes, dust, electricity and moving parts, and that the activities can cause serious injury, illness, permanent disability, death, and damage to property. Some risks cannot be removed without changing what a workshop is. Other people in the shop may make mistakes that affect me.
I assume the risks. I take part voluntarily and I accept all risks of the activities, known and unknown, including risks caused by the condition of the space or its equipment and by the actions of other people.
I will work safely. I will not use a tool or machine until I have been trained on it and signed off where CGW requires it. I will follow posted rules, my trainer’s instructions and the code of conduct; wear the protective equipment the task calls for; stop and ask when I am unsure; and report damage, unsafe equipment and injuries right away. I will not use equipment while impaired by alcohol, drugs or fatigue. I understand that CGW may stop me using any tool or ask me to leave if I work unsafely.
Release, including negligence. To the fullest extent the law allows, I release, waive and discharge CGW, its board, officers, volunteers, trainers, members, landlord, and sponsors (the “released parties”) from all claims, demands and liability for injury, illness, death, or loss of or damage to property arising from the activities, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF ANY RELEASED PARTY. I promise not to sue any released party for those claims. This release does not cover gross negligence or intentional misconduct.
Indemnity. I will defend and indemnify the released parties against any claim, cost or liability, including reasonable attorney’s fees, that arises from my own actions or my use of the space, including claims by my guests.
My property and projects. CGW is not responsible for loss of, theft of, or damage to my belongings, materials or projects, whether stored in the shop or in use.
Medical care. I am physically able to take part. If I am hurt and cannot decide for myself, I allow CGW volunteers to call emergency services and to arrange first aid or medical care for me, at my own cost.
Photos. CGW may take photos or video at events and in the shop and use them to promote CGW. I can ask CGW not to use pictures of me by emailing mail@columbiagadgetworks.org.
Minors. If I sign as the parent or legal guardian of a person under 18, I agree to all of the above for them and for myself, I accept the risks on their behalf, and I will make sure they follow the safety rules. I understand that a minor must be accompanied by me or another responsible adult when CGW requires it.
The whole agreement. This agreement is governed by the laws of the State of Missouri. If any part of it is found unenforceable, the rest still applies. It stays in effect for every visit until I withdraw it in writing; withdrawing it ends my use of the shop.
I HAVE READ THIS AGREEMENT. I UNDERSTAND THAT BY SIGNING IT I GIVE UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR INJURY CAUSED BY NEGLIGENCE, AND I SIGN IT VOLUNTARILY.
